Is Alberto Gonzales practicing law or lawlessness?

One point made by Gonzales puzzles me.

" ... a judge will never be in the best position to know what is in the national security interest of our country"

I have always been under the impression that a judge is on the bench to rule on constitutionality and legality and not what is in someone's best interest.
